Do I need a permit to add a mini split or window unit in North Carolina?

North Carolina adopts a building code statewide, so there is a single baseline every local building department starts from. That makes the typical rule below a better guide here than it is in a home-rule state — but adoption is the floor, not the whole answer: local amendments are still permitted, and a city that has tightened a threshold is not obliged to advertise it.

What changes the answer
- Window or portable air conditioner — exempt as a portable cooling appliance
- Self-contained refrigeration under about 10 pounds of refrigerant and driven by a motor of 1 horsepower or less — within the code's exemption
- Ductless mini split — a fixed system with a wall penetration, a line set and a dedicated circuit: typically permitted
- The electrical side is its own item — a mini split needs a dedicated circuit and a disconnect at the outdoor unit
- A DIY pre-charged mini split is still a fixed installation, and being pre-charged changes nothing about the permit
These thresholds come from the model code. North Carolina lets its cities and counties amend the code they adopt, and an amended threshold is usually where people get caught.
IRC R105.2 exempts portable heating, cooling and ventilation appliances, and self-contained refrigeration systems containing 10 pounds or less of refrigerant actuated by motors of 1 horsepower or less. A fixed split system falls outside that; mechanical permits come from IRC Chapters 13–24 and the electrical work from the adopted NEC.
Why it matters
The consequential half is electrical rather than mechanical: a condenser on an undersized circuit or without the disconnect at the unit is a fire and a hazard to whoever services it later. On the refrigerant side, a line set brazed without nitrogen purge fills the system with oxide scale, which is the usual reason a cheap install fails within a couple of years.
